Welcome to Delta Outfitters Fishing Charters ("we", "us", "our"). By booking a fishing charter with us, you ("you", "your", "client") agree to the following terms and conditions. Please read them carefully before making a reservation.
1. Reservation and Payment
- All reservations require a $100 deposit to secure your booking.
- Full payment is due on the day of the charter before departure.
- We accept payment by cash, credit card, and other payment methods as outlined on our website.
- A booking is only considered confirmed once the deposit has been received and confirmed by us.
2. Cancellation and Refund Policy
- Customer Cancellations: Cancellations must be made at least 72 hours in advance for a full refund of the deposit.
- Late Cancellations or No-shows: Cancellations made less than 72 hours before the scheduled charter or no-shows are subject to the loss of the deposit.
- Weather Cancellations: If weather conditions or unforeseen circumstances (e.g., storms, unsafe conditions) prevent the charter from proceeding, we will reschedule the trip or provide a full refund. The decision will be made by the captain based on safety.
- Refunds: Refunds will not be issued for any partial trip, early return, or weather-related interruptions unless deemed necessary by the captain.
3. Fishing Equipment
- We provide all necessary fishing equipment, including rods, reels, tackle, and bait.
- Clients are welcome to bring their own fishing gear, subject to prior approval.
- Clients are responsible for the safekeeping of any personal items brought onboard, including fishing equipment, phones, or cameras. We are not liable for any lost or damaged items.
4. Liability Waiver and Assumption of Risk
- Fishing involves inherent risks, including but not limited to slips, falls, sun exposure, seasickness, and injury from equipment or fish.
- By booking with Delta Outfitters Fishing Charters, you agree to assume all risks associated with the activity.
- Minors must be accompanied by a parent or guardian.
- We are not responsible for any injury, loss, or damage to personal belongings that occurs during the charter.
5. Age and Health Requirements
- Clients must be at least 18 years old to participate in the charter without a parent or guardian.
- Clients should notify us in advance of any medical conditions or health concerns that may affect their participation in the charter.
- Clients should be physically capable of handling the demands of fishing, which may involve standing for long periods, handling fish, or navigating uneven surfaces on the boat.
6. Fishing Regulations
- We comply with all local, state, and federal fishing regulations. Clients are expected to abide by these laws, including limits on catch sizes and species.
- The captain reserves the right to terminate the trip if clients engage in illegal fishing practices or fail to follow the captain’s instructions.
7. Charter Duration
- Charters are 5 hours long unless otherwise agreed upon. The trip will end at the agreed-upon time or earlier if conditions require it.
- If the trip is cut short by the captain for safety or other operational reasons, a partial refund may be issued.
8. Weather Conditions
- Weather conditions can change rapidly, and safety is our top priority. If the weather is deemed unsafe, we may cancel or reschedule the trip. In such cases, you will be offered the option to reschedule or receive a full refund.
- Clients are advised to check the weather forecast prior to booking and prepare accordingly for the conditions expected during the trip.
9. Alcohol and Drugs
- Alcohol is allowed on board, but it is important to drink responsibly. Excessive drinking that affects the safety and enjoyment of the trip will result in termination of the charter with no refund.
- The use of illegal drugs is strictly prohibited, and clients found violating this policy will be asked to leave the boat immediately with no refund.
10. Privacy and Data Protection
- We respect your privacy. Any personal information collected during the booking process will be used solely for the purpose of providing services to you and will not be shared with third parties without your consent, except as required by law.
- By booking with us, you consent to the use of your contact information for communication regarding your charter and promotional offers unless you opt-out.
11. Amendments to Terms and Conditions
- Delta Outfitters Fishing Charters reserves the right to amend these Terms and Conditions at any time. Any changes will be posted on our website, and the new terms will apply to all bookings made after the date of the change.
- It is your responsibility to review these Terms and Conditions before booking your trip.
12. Governing Law
- These Terms and Conditions shall be governed by and construed in accordance with the laws of the state of Louisiana.
- Any disputes arising from these terms will be resolved in the courts located in St. Bernard Parish, Louisiana.
